These General Terms of Use govern the use of Origo, a platform for hosting software projects. This platform is a product of the ETH spin-off company Oriact GmbH. Oriact is also the operator of the platform.
The main purpose of this platform is to host software projects. In addition, it provides other software development services – such as: web pages for the software projects in development, communication services for developers or users, management of developers, bug tracking and downloading services.
The platform can be used by both the ETH members and the public. It is intended to support the development of software projects and their dissemination. The platform may be used only to obtain the services offered in connection with software projects and not to host data that is not part of the software projects developed – such as music, video and similar data.
The operator determines whether or not a software project will be hosted on the platform. He may remove software projects which he does not wish to host from the platform, without having to obtain the consent of the platform user concerned.
By hosting the software projects, the ETH Zurich does not obtain any rights other than the ones it already has in such projects. The hosting of a software project creates no legal or commercial relationship between the user and ETH Zurich and does not entitle the user to claim any endorsement of the hosted software by ETH.
The user can acquire different entitlements and rights to the software project. The owner of the software project determines which entitlements or rights are to be conferred or granted under license.
ETH Zurich has the exclusive right to use the software created by the persons who are in an employment relationship with the ETH Zurich in the course of performing their official duties (s. Art.(2) of the ETH Law)[1]. The person in question must ensure that she/he has the right to use the software in connection with the services provided on the platform. In other words, she/he must protect the rights of the ETH Zurich.
The operator, that is Oriact GmbH, assumes no responsibility or liability for:
The user may be held responsible or liable for:
The operator will abide by the data protection principles. Any traces left by the users while using the platform and the services which could serve to identify an individual (e. g. e-mail address) will be removed or anonymized.
The operator, Oriact GmbH, reserves the right to use the anonymized data for statistical purposes.
The exclusive venue is in the courts of Zurich. In addition to these Terms of Use, Swiss law is also applicable. Moreover, the ETH Zurich's own regulations apply to the ETH Zurich members[2].
